Can't we all just get along? Judge Lucy Koh is reportedly hoping that Samsung and Apple can come to some sort of patent agreement rather than send the case to the jury.

As reported by the Wall Street Journal, Judge Koh said there are "risks here for both sides" in letting a jury decide whether Samsung copied the iPhone and iPad with its Galaxy lineup of devices. She urged both sides to try talking it out one more time; lawyers for both sides said they would try.

An agreement is not likely, however. One look at the almost 1,800 documents that have been filed in the case indicates that this issue is far from being resolved. Apple and Samsung have been arguing non-stop about everything from which they can use during the trial to whether by releasing a statement to the press.

Apple and Samsung execs tried to negotiate - twice - before the patent trial kicked off in California earlier this month but to no avail. Apple's Tim Cook and Samsung's Choi Gee-Sung and again just days before the trial started, but over the value of each others' patents.

According to Apple, Samsung should for infringing on it's products. Recent documents submitted to the court how much Apple felt Samsung owed it per product. The devices that appear to be the most infringing are the original Galaxy S (i9000) and , both of which violate three Apple utility patents, three design patents, and three trade dress claims, according to Cupertino.
